COURT REFUSES TO EXTEND PRISON FOR MAN INVOLVED IN CHILD ABUSE IMAGES
Prosecutors failed to persuade appeal judges to lengthen the prison term of Michael Leith, aged 48, who was convicted of participating in a crime involving an indecent photo of an abused child.
Crown lawyers aimed to have his 18-month sentence extended but the Court of Criminal Appeal in Edinburgh refused their request.
Leith had been involved in a disturbing case where he had received an indecent image of a young girl who was assaulted and unable to be named for legal reasons.
It was revealed that Leith was a prisoner at HMP Perth at the time of sentencing.
He pleaded guilty to attempting to conspire to rape and sexually assault a young girl, as well as to taking indecent photographs of her during July 2013 and July 2014.
The case had earlier involved internet communications and travel to the child's home in Dunfermline, where Leith urged Muriel Melville to commit rape.
The court heard how Melville, a former dinner lady, sexually assaulted the young girl and received the indecent photo from Leith.
Melville was sentenced to two years and four months in prison and was placed under supervision for two years after her release.
The appeal court decided against extending Leith’s sentence but imposed a three-year supervision order to start upon his release.
The judges acknowledged the difficulty of the sentencing but upheld the original 18-month sentence, stating that the judge had acted correctly, but concluded that a supervision order was appropriate.
