Kevin Daily, residing at Melrose Court, was given a 12-month detention at Jedburgh Sheriff Court last Thursday after pleading guilty to the incident that took place behind a local primary school.
Sheriff Kevin Drummond told him: "You have pled guilty to an indecent assault that occurred while you were on a deferred sentence for good behavior and under two bail conditions." The 16-year-old appeared in court with his head lowered as Sheriff Drummond sentenced him to a prison term, which was back-dated to June 26.
The offence was committed around 9 p.m.
on June 24 behind Wilton Primary School, while Daily was intoxicated.
The young girl shouted for help, prompting assistance from her friends.
Prosecutor Graham Fraser noted, "Although she is not entirely naive, the girl was understandably distressed by the incident, which took place late at night in a dark area." Defence solicitor Ronnie Bain mentioned that Daily had been drinking in several pubs before the offence, stating, "He was drinking from a bottle of Buckfast and described himself as 'out of it.'" Mr.
Bain pointed out that Daily had a history of truancy during his high school years.
"His time in custody has made a significant impression on him, and he has taken steps to address his alcohol consumption." The lawyer requested that the sheriff consider whether the case should be classified under the sex offenders' register.
In addition, Daily received a concurrent three-month sentence after admitting to stealing alcohol and sweets from Spar on North Bridge Street on November 25.
He was also reprimanded for failing to appear in court on January 9.
