CUMNOCK MAN SENT SEXUAL MESSAGES TO 'BOYS AGED 13 AND 14'
A Cumnock creep who sent pictures of his naked genitals and buttocks to 'boys aged 13 and 14'—who were both undercover cops—has been sentenced.James McGarry, aged 46, pleaded guilty to two attempts to cause an older child to view sexual images and to attempting to communicate indecently with an older child.
He returned for sentencing on Thursday, December 18.
The court heard McGarry admitted contacting both 'boys' intentionally for the purpose of obtaining sexual gratification or humiliating, distressing, or alarming a person he believed to be a child under 16.
He contacted the first 'child,' who he thought was 13 but was actually an undercover police officer, between March 1 and April 4, 2023.
He caused him to view sexual images and sent a series of sexual written communications, including images of a naked male's buttocks and private parts inside boxer shorts, sharing further messages where he discussed his desire to commit sexual acts on him.
He also inquired about the size of his privates, described his genitals, asked to see his buttocks, and requested private images.
Additionally, he discussed his sexual preferences and fantasies with him.
McGarry also sent similar images and messages to a 'boy aged 14' between January 3 and 5, 2024, including an image of an aroused member and messages about his desire to have sex with him, asking about his privates and describing his own.
Defence solicitor John Gallagher stated that McGarry was aware this was a very serious matter and was embarrassed about his behaviour, citing underlying difficulties with alcohol.
The court noted offences possibly took place at his workplace.
Sheriff Michael Meehan emphasized the seriousness of the offence, stating that McGarry knew the gravity of his actions.
Although the offence exceeded the custody threshold, considering his lack of previous record, a community payback order for two years with a six-month review was imposed.
He will be subject to two years of social work supervision, 200 hours of unpaid work in nine months, police notification requirements as a registered sex offender for two years, a four-month tagging order, and a restriction of liberty order preventing him from leaving home between 7 pm and 7 am.
