    In May 2016, Mohammed Hussain, a man with a troubling criminal history, found himself at the center of a legal controversy involving allegations of violating a court-mandated sex offender’s restriction. Hussain, who owns the Tandoori Fusion restaurant located in Gatley, was accused of breaching the terms of his sexual harm prevention order by establishing his business premises in close proximity to a public park, specifically Walter Stansby Memorial Park.

    According to the terms of his order, Hussain is prohibited from entering within 50 metres of any park, amusement arcade, swimming pool, or recreational area primarily used by children. This restriction was imposed following his conviction for grooming two young girls, a case that led to his sentencing and the subsequent restrictions on his movements. The order aims to prevent any potential contact with minors and to mitigate the risk of reoffending.

    On March 14, police officers responded to concerns raised about Hussain’s business location. It was found that Tandoori Fusion was situated approximately 40.7 metres from Walter Stansby Memorial Park, a site that is notably used by Brownies and other youth groups for gardening activities. The proximity of Hussain’s takeaway to this park raised suspicions that he might be in breach of his court order, which explicitly forbids him from being within 50 metres of such recreational areas.

    Hussain, who resides in Adswood, appeared before Stockport Magistrates Court to face charges of breaching his sexual harm prevention order. During the hearing, his defense lawyer, James Warburton, argued that the order’s restrictions were limited to designated areas where children are present. He contended that because Walter Stansby Memorial Park is a memorial park, it might not fall under the category of areas where children are regularly present, thus possibly not violating the order.

    However, the prosecution, led by Kate Gaskell, countered this argument by emphasizing that the distance from the park was only 40.7 metres, which is within the prohibited zone. She pointed out that the park is actively used by children, including Brownies, for gardening activities, and that the restriction applies to any park, regardless of its specific designation or memorial status. The court was informed that the matter was being adjourned, with a trial scheduled for August 5 to thoroughly examine the case.

    Hussain’s criminal history includes a previous conviction in January 2008 at Derby Crown Court, where he was found guilty of similar offenses. The current order he is subject to restricts him from entering recreational areas used by children or coming within 50 metres of such places unless he is traveling via public transport, private hire vehicle, or if the breach is inadvertent. His arrest in connection with this case followed an earlier breach in 2013, when he was caught asking a girl for her phone number while she was walking to school. That incident resulted in a three-year community punishment order and supervision.

    Despite the legal restrictions, Hussain’s attempt to operate a takeaway near a park used by children has raised serious concerns about compliance and public safety. The case continues to be closely watched by authorities and the local community, who remain vigilant about the potential risks posed by individuals with a history of offending against minors.
