MANSFIELD MAN GETS SUSPENDED SENTENCE FOR PUSHING PARTNER OUT OF CAR AND FRACTURING HER COLLARBONE
A woman remains in a relationship with a bricklayer and is pregnant with his child after he tried to push her out of a moving car, then fractured her right collarbone in a later attack.The incident occurred on May 19 last year.
Jamie Burbanks, 30, of Heathfield Road, Mansfield, was driving along Mansfield Road, Clipstone, when an argument started with the woman in the passenger seat, as explained by prosecutor Mark Knowles.
He repeatedly pulled her hair, pushed her out of the car, and once they stopped at her home, neighbors saw her screaming.
Burbanks then grabbed her clothing, pushed her backwards, threw her to the floor, and punched her twice.
She was found bleeding from her head and in great pain, with police ultimately diagnosing a fractured collarbone at hospital.
Despite her injuries, she did not want to provide a statement but was found to have injuries caused by Burbanks.
He claimed she was the aggressive one, and that he was unaware of her injuries.
Burbanks pleaded guilty to inflicting grievous bodily harm at an earlier court hearing.
Judge Timothy Spencer QC sentenced him to 16 months in prison, suspended for two years, with a requirement to attend a 31-day 'Building Better Relationships' course.
The judge noted Burbanks's previous convictions, including a 2013 conviction for thrusting a glass in someone's face, and a conviction for common assault and battery.
He acknowledged provocation but described the act of pushing her out of a moving car as 'appalling.' Burbanks is still with his partner, who is 18 weeks pregnant, and the couple intends to have their first child.
