MANSFIELD DAD CLEARED OF ATTEMPTED MURDER AFTER STABBING SON
A Nottinghamshire father who stabbed his own son in a garden has been cleared of attempted murder.Following a trial at Nottingham Crown Court, a jury took four hours to unanimously clear Anthony Kimberley of the more serious charge.
Instead they convicted him of a lesser charge of wounding with intent to cause grievous bodily harm.
The 59-year-old first stuck the blade into his 39-year-old son’s chest and then twice more to his arm as the victim tried to defend himself.
The victim told the jury he remembers walking up the street before collapsing, and the next thing he recalled was waking up in hospital.
Adjourning sentence until Friday, April 17, and remanding the defendant into custody, Judge Stuart Rafferty KC told the 59-year-old defendant: “This is an offence which requires a dangerousness assessment so I will adjourn sentence.” The stabbing took place in the garden of an address in Garibaldi Road in Forest Town, Mansfield, on August 2, last year.
The victim said his mother and father came to the address after visiting a pub.
An argument began and the victim went out into the garden, where the attack took place.
The father-of-two replied: “We started arguing about my kids.
My mum and dad don’t have much to do with my kids and it winds me up, it is always about my sister’s kids and not mine.
I went out into the back garden, I just wanted to get out.
He came out and started swinging for me so I grabbed him and he hit me.
I said ‘I’m your son stop hitting me’ and he must have slipped, I don’t know what on (because) the garden is like a junkyard.
He got up, I did not see where he went and the next thing I knew I had been stabbed, I don’t know where it came from.” Asked by the detective if he saw any weapon in his father’s hand, the witness replied: “No.” The victim continued: “He said ‘I am going to kill you’ and I felt him stab me to the chest.
It felt cold, then I just hit him and walked off.
Asked how hard he hit his father, the witness replied: “I punched him and then I realised I was hitting my own dad so I just walked away.
“I hit him as hard as I could because he had just stabbed me.
I then started walking up the street holding my chest.
I just wanted to get away and then I collapsed.” The detective asked him: “What is the next thing you remember?” Mr Kimberley replied: “Waking up in hospital.” The detective asked: “Had there been any violence or threats before?” He replied: “No.” She said: “Do you know why he did this?” The witness replied: “No, no”.
