MAN 'UNINTENTIONALLY' DOWNLOADED CHILD ABUSE PHOTOS
A man from County has narrowly avoided incarceration despite being found with a collection of indecent images of children downloaded onto his phone.James McGuigan, aged 39, was discovered to possess 42 images depicting the sexual abuse of minors aged between seven and 15 during a police raid on his home in June of the previous year.
The Edinburgh Sheriff Court was informed that officers confiscated devices during their search, uncovering 14 images classified as Category A—the most severe—along with nine in Category B and another 19 in Category C stored on his mobile device.
McGuigan, who resides on Grange Crescent East in Prestonpans, admitted to the charges last month and appeared before the court for sentencing on Monday.
His lawyer, James Stewart, explained that his client claimed to have accessed the material unintentionally and expressed remorse, accepting responsibility for his actions.
Mr.
Stewart requested that the court consider the recommendation in the social work report, which suggested a non-custodial punishment as an alternative to jail.
During sentencing, Sheriff Graeme Watson stated: “These are serious offences, and you pled guilty under section 76 to either taking or allowing the taking of indecent images, as well as possessing such images.
“These crimes involve genuine victims.
The act of seeking out this material fuels the demand that drives the production of such images, and if you received these images unintentionally, you still had a duty to report it—and failed to do so.” The sheriff noted that the severity of the offences met the criteria for imprisonment but indicated that he could handle the case with a direct alternative to custody.
Consequently, McGuigan was sentenced to two years of supervision by the social work department and ordered to complete 150 hours of unpaid community service.
He was also registered on the sex offenders list for two years and subject to a conduct requirement, which included restrictions on internet access.
He admitted to possessing and creating—or permitting the creation of—indecent images of children at his residence between January 19, 2022, and October 28, 2024.
