PERTH COURT ORDERS DETENTION FOR INSANE RAPIST BELIEVING HE WAS A LEGIONNAIRE

A RAPIST who believed he was a foreign legionnaire and donned combat fatigues before carrying out a prolonged and vicious attack on a young mother, was ordered to be detained at the State Hospital Carstairs, at the High Court in Perth, yesterday.

The court was told Garry Ovens entered by the back door and assaulted the woman in her home in Glenrothes, raping her three times and then forcing her to make him a meal before he left.

He then went to the home of the woman's boyfriend and assaulted him and one of his friends.

Ovens pleaded not guilty to six charges, on the grounds of insanity, which was accepted by the Crown.

Lord Milligan ordered him to be detained at Carstairs and released only under the supervision of the Secretary of State.

Advocate Depute Gerry Moynihan told the court Ovens had previously had a relationship with his victim and had found out she had a new boyfriend and telephoned her to arrange for a chat.

When he went to her home on August 24 last year, he entered by the unlocked back door and spoke to the woman.

Ovens then began to remove his clothes and lunged at the woman, grabbed her by the throat, slapped her, and forced her to the ground.

He made her undress and raped her before forcing her to perform oral sex.

She was then sexually assaulted again before he took her back into the living room.

When she then refused to return to the bedroom Ovens pulled a knife and threatened to slit her throat.

He then pinned her to the bed and raped her again.

Mr Moynihan said: 'He then required her to make him something to eat and give him something to drink.' Carstairs consultant forensic psychiatrist Dr William Black, 36, said Ovens was suffering from manic depression.

He was in a state of 'hypomania' at the time of the attacks.

Dr Black said: 'Ovens delusion was that he was a member of the foreign legion with special fighting and other powers.' He added that Ovens should be kept in secure conditions because he posed a danger to the public.

The court heard that although Ovens was insane at the time of the offence he was now considered sane.

Lord Milligan placed Ovens on the Sex Offenders Register and ordered him to be sent to Carstairs.
