IRVINE MAN NARROWLY AVOIDS JAIL AFTER ASSAULT AND ABUSE
A MAN has narrowly avoided a jail sentence after he admitted assaulting his ex-partner at Eglinton Park last month.Edward Dally, 46, of Irvine, appeared at Kilmarnock Sheriff Court last week where the court heard how he and the complainer were in a relationship which had ended in June 2014.
The couple had a child together who was born in 2012.
On February 7, arrangements were made to attend the park, with the woman and the child picking up Dally and noticing him to be under the influence of alcohol.
The woman made him promise to behave.
After arriving at Eglinton Park, the woman said Dally was trying to be smart and swearing in front of his child.
He was told that it wouldn’t be tolerated to which Dally replied with a string of foul abuse.
He was told at this point he would be walking home.
Dally followed them back to the car before jumping in the vehicle.
He was told to get out but he didn’t and demanded that the woman drive.
He then said: “I’m going to put my killing hand on you if you don’t get in the car and drive.” Dally grabbed the woman by the throat but she broke free and called 999.
Dally punched the car twice before leaving.
Sheriff Shirley Foran said: “For any male, this is appalling conduct, but for a man of your age it is utterly incomprehensible.” Dally was sentenced to 250 hours of unpaid work, 12 months of supervision and he was given a 12-month non-harassment order.
