SPALDING MAN CONVICTED OF STRANGULATION AFTER RAPE ACQUITTAL
A notable case involves Zigbeniew Kaczmaek, aged 51, from Carrington Road in Spalding, who was brought before Lincoln Crown Court.He was acquitted of two rape charges, with the jury finding him not guilty, but was convicted on three other charges, including intentional strangulation and suffocation, which occurred in December last year.
The trial lasted eight days, during which the jury was directed to find Kaczmaek not guilty of two up to then unmentioned additional rape charges, and no evidence was provided concerning an assault charge.
Kaczmaek, who had no prior convictions, denied all the charges faced.
He is scheduled for sentencing at Lincoln Crown Court on December 13, 2024.
His defense attorney, Chris Jeyes, stated he had been in custody throughout proceedings and would not request a Probation report, citing some prior use of alcohol but noting he had abstained for 12 months.
The trial judge, Judge James House KC, remanded Kaczmaek into custody and indicated that an impact statement from the victim, who remains anonymous for her protection, would aid in sentencing.
The judge explained, 'I am adjourning your case for sentence.
I am not asked for a pre-sentence report and I don't order one.
But it is better for a period to reflect on matters, so I will sentence you on December 13.' He emphasized the seriousness of the offences, suggesting a custodial sentence is likely, and highlighted the need for reflection before sentencing.
