KILMARNOCK MAN SPARED JAIL FOR INDECENT IMAGES OF CHILDREN
A KILMARNOCK man has been spared jail after admitting to having indecent images of children.
Stuart McDonald, 32, of Duncan Court, previously pleaded guilty to having in his possession indecent photographs or pseudo-photographs of youngsters at Rankin Court in the town between June 14, 2022 and April 11, 2023.
He also admitted a separate charge of being in possession of cannabis in the same place on April 11, 2023.
Appearing for sentencing at Kilmarnock Sheriff Court on Monday, March 24, his solicitor Graeme Cunningham said that McDonald was appearing as a first-time offender.
He added: "I usually ask for an alternative to custody for first offenders so Mr McDonald can realise the error of his ways." Sentencing, Sheriff Nicola Patrick said: "The threshold for a custodial sentence is met, but you appear as a first offender." McDonald was ordered to undertake three years of supervision, as well as the Moving Forward Making Changes programme.
He was also placed on a curfew for the next six months, where he must stay in his home from 7pm to 7am each night.
He has also been placed on the sex offenders register for three years.
