AYRSHIRE RAPIST SCOTT SMAIL JAILED FOR SIX YEARS AFTER VICTIM RAPE CLAIM
A rapist who moaned he was instead “a victim” has been jailed for six years, writes Grant McCabe.Scott Smail, 50, took advantage of a woman at his home in Kilmarnock on August 28, 2021.
The pair had earlier been together at a bar and a restaurant in the town before getting a taxi to the property.
Both of them had earlier been drinking.
It was at the house where the woman then “passed out”.
She eventually awoke to find Smail raping her.
The woman started crying and the sick predator told her: “There is no point greeting now.” She got dressed and escaped in a cab before telling a relative what had happened.
Smail was sentenced at the High Court in Glasgow having earlier been convicted of a rape charge.
Judge Louise Arrol KC told him that the ordeal has had a “catastrophic effect” on the woman adding “the impact is immeasurable”.
She then remarked: “You accept no responsibility for the offence.
You sought to minimise your involvement by stating that you are the victim.
For the avoidance of doubt, you are not.
You have also demonstrated no empathy or remorse.
You preyed on a vulnerable female, (who was) intoxicated, taking advantage of her.
My assessment is that culpability is high.”
