MAN CAUGHT ON CCTV ASKING WOMAN WITH DEMENTIA TO PERFORM SEX ACT
A 70-year-old man, employed as a painter and decorator at an elderly woman's residence, requested her to perform sexual acts on him despite knowing she suffered from dementia.Rodger McKindley from Ormskirk Road, Skelmersdale, appeared at Liverpool Crown Court to receive his sentencing.
The court was informed that McKindley engaged in a sexual act on himself five times with a woman in her eighties present, and on another occasion, convinced her to touch his genitals.
Prosecutor John Win-Williams explained that McKindley had worked multiple times at the victim's house as a painter and decorator.
The victim was described as a vulnerable woman with dementia, cared for in a shared residence.
Investigators found cigarettes in her flat, prompting her daughter to review CCTV footage, which captured the incidents.
One clip revealed McKindley instructing the woman to "go on, try it,” despite her saying no.
The prosecutor emphasised that McKindley, who held a position of trust, exploited her vulnerability to satisfy his sexual needs.
During police interviews, McKindley initially tried to blame the victim and falsely claimed he was searching for sandpaper in his pocket.
A victim impact statement read by her daughter outlined the emotional trauma caused.
She expressed fear about leaving her mother alone but acknowledged the need to do so, noting that the incident has tainted her cherished memories of her.
The daughter also stated that the CCTV footage is the last thing she sees before bed and the first in the morning, and that her family now hesitates to have workmen in their home.
Judge Trevor-Jones labeled the offenses as "predatory" and "demeaning," occurring over four weeks between April and May, and causing significant trauma.
He remarked that McKindley took pleasure in his actions and was fully aware of her dementia.
Defence attorney John Rowen admitted that McKindley exploited the trust placed in him and expressed his client's struggle to understand his own behavior.
McKindley pleaded guilty to sexual activity contrary to section 2 of the Sexual Offences Act.
He received a sentence of 20 months in prison and will be registered on the sex offenders register for 10 years.
