NICHOLAS CHARLTON FROM KENILWORTH ESCAPES JAIL DESPITE CHILD PORNOGRAPHY CHARGES AT WARWICK CROWN COURT

In a case that has shocked the community of Kenilworth, Nicholas Charlton, a property manager residing on Mountbatten Avenue, faced serious allegations related to the possession and creation of indecent images of children. The proceedings took place at Warwick Crown Court, where Charlton admitted to multiple charges involving child exploitation material.

According to court records, Charlton, aged 58, confessed to police that he had discovered images on his computer depicting children in a state of nudity, which he described as 'titillating.' Despite acknowledging these images, he claimed that he did not view them as pornographic, even though his collection included other images showing children being sexually abused by adults. This distinction was scrutinized during the trial, as the severity of the images was clearly established.

Warwick Crown Court was informed that Charlton had been charged with ten counts of making indecent photographs of children, alongside a single count of possessing a total of 254 such images. The court heard that he had downloaded a variety of images, some of which depicted children in erotic poses, categorized as level one. More disturbingly, the collection also contained images showing sexual activity involving children, with 12 images illustrating sexual acts between or by individual children, and five images depicting non-penetrative sexual acts between adults and minors. Among these, one image was classified as level four, showing penetrative sex between adults and children, while a deleted file was identified as level five, indicating sadism or bestiality.

Despite the gravity of these offenses, Charlton was spared a custodial sentence. Instead, he was sentenced to a three-year community rehabilitation order. The court imposed strict conditions, including a prohibition from working with children or seeking unsupervised contact with minors. Additionally, Charlton was ordered to participate in a sex offender treatment program, cooperate with psychological assessments, and register as a sex offender for five years. He was also required to pay costs amounting to £578 and to forfeit his computer equipment.

Details of the police operation reveal that Warwickshire police raided Charlton’s home in April of the previous year. The investigation was prompted by international efforts, particularly US investigations into a database that listed credit card details used by individuals to access child pornography. During the search, authorities discovered that Charlton’s computer contained 161 saved images and 93 deleted ones. The images ranged from level one to level four, with the most disturbing being the penetrative images involving children. The presence of such material was deemed highly illegal and morally reprehensible.

During the sentencing, Recorder David Jones acknowledged the seriousness of the offenses but also noted the remorse shown by Charlton. The judge stated, “These are disgraceful offences but he has been deeply humiliated and shamed. He has written to all his friends to tell them what he has done. I don’t think a custodial sentence is necessary.”

Furthermore, the judge emphasized the broader implications of possessing such images, explaining, “What you did is not a direct abuse of the children because it has already taken place but you create a market for it. That positively encourages the pornographer, the one who is actually abusing these children, to do it more and more.” This statement underscores the damaging impact of such material, which fuels the demand and perpetuates the cycle of abuse.
