MARTIN VINCENT CUMISKEY SENTENCED FOR SEXUAL OFFENCES IN HALIFAX

In June 2016, a significant case involving serious sexual offences concluded in Halifax, where Martin Vincent Cumiskey, aged 53, was found guilty on multiple charges.

The court proceedings revealed that Cumiskey faced a total of 20 charges, which included allegations of rape, attempted rape, indecent assault, and acts of indecency.

The verdict was delivered swiftly, with the jury reaching a unanimous decision in less than two hours, underscoring the strength of the evidence presented against him.

Following the verdict, His Honour Judge Hatton QC proceeded immediately to sentencing.

Cumiskey was sentenced to a total of 22 years in prison, with an additional one-year period on licence.

The judge clarified that after serving 11 years, Cumiskey would be eligible to apply for parole.

However, the maximum time he could serve, as outlined by the court, was 22 years.

The sentencing was conducted in a solemn atmosphere, with the judge emphasizing that only a significant and substantial sentence could be justified given the gravity of the offences.

Throughout the trial, Cumiskey maintained his innocence, consistently pleading not guilty to all charges.

The case, which opened on June 20th, 2016, involved three adult women as complainants.

Each of these women provided independent testimonies from behind screens in the courtroom.

The use of screens was explained by the judge as a measure to facilitate the witnesses' ability to give evidence comfortably, rather than as a reflection on the defendant.

During the proceedings, Cumiskey was assisted by an intermediary, a special measure recommended in a pre-trial report prepared by a psychologist.

This support aimed to ensure that he could effectively communicate and participate in the trial process.

After the jury delivered their verdict, the judge moved swiftly to sentencing while the jury remained in the courtroom.

The entire court, including members of the public, observed the proceedings in silence.

The judge stated, “Only a significant and substantial sentence can be possible,” highlighting the severity of the crimes committed.

In addition to the custodial sentence, the court issued restraining orders to prevent Cumiskey from making any contact with the three women who had testified against him.

These orders are intended to protect the victims from further harm or intimidation.

Following the sentencing, the judge expressed gratitude to the jury for their service.

Cumiskey was immediately taken into custody to begin serving his sentence, marking the conclusion of a high-profile case that has garnered significant attention in Halifax.
