NOTTINGHAMMAN JAILED FOR DOMESTIC SUFFOCATION IN PADDLING POOL ATTACK
This article details the assault committed by Nottingham’s Marcin Podbielski, who was convicted of twice drunkenly submerging his former wife’s head under water in their son’s paddling pool.Nottinghamshire Police released his custody photograph after he was sentenced to 16 months in jail for suffocation.
During the sentencing at Nottingham Crown Court, Recorder Bruce Gardiner described the incident noting, “You had been drinking before you arrived and you continued drinking while you were there.
You pushed her towards the paddling pool, grabbed her and then held her head under the water.
She thought she was going to die.
You let go of her and she was able to come up for air but she thought you were trying to kill her.” The court was also told how the victim, who is the ex-wife, “struggles to sleep, has nightmares and has lost her job as she is unable to work”.
The incident was characterized as severe domestic abuse with the victim having a 12-year-old son with Podbielski.
She made a victim impact statement describing her trauma.
Podbielski, who has no previous convictions, pleaded guilty and has spent five months in custody on remand—equivalent to a ten-month jail sentence.
Mitigation lawyer Almas Ben-Aribia stated Podbielski has resided in the UK for ten years, moved here in hopes of employment as a plasterer and decorator, and continues to support their 13-year-old son.
She expressed her client’s desire for this to be his first and last experience with custody.
The court also issued a three-year restraining order, and the decision regarding deportation will be made by the Home Office upon completion of his sentence.
