DUNS MAN BANNED FROM KEEPING ANIMALS FOR FIVE YEARS AFTER NEGLECTING DOG
A 42-YEAR-OLD man who admitted causing a dog unnecessary suffering by failing to get it veterinary treatment has been banned from keeping animals for five years.
It was found that the dog, a Staffordshire bull terrier cross named Otto, was suffering from neglect for about six months and was in significant pain.
The incident occurred at the defendant's home in The Mount, Duns, between January and July 2023.
Prosecutor Drew Long described how the Scottish SPCA was alerted after a complaint about the dog's condition.
An inspector observed the dog suffering from hair loss and flaky skin, indicating poor health.
The defendant, Kevin Mulvey, pleaded guilty to the offence.
Defense lawyer Ed Hulme stated that Mulvey was aware of the dog's deteriorating condition but lacked the funds to provide veterinary care at the time.
He expressed that Mulvey now realises he should have taken the dog to the Scottish SPCA himself.
Sheriff Peter Paterson, acknowledging the prolonged period of neglect, imposed a five-year ban on Mulvey from keeping animals.
Additionally, a fine of £300 and a £20 victim surcharge were imposed.
