JONATHAN BERMINGHAM FROM FALKIRK SENTENCED TO LIFE FOR RAPE OF SCHOOLBOY
In a case that has shocked the community of Falkirk, 19-year-old Jonathan Bermingham, who prefers to be known as Jonathan Ross, was sentenced to life imprisonment after being convicted of the heinous crime of raping a young schoolboy. The incident took place in a wooded area near Glenfuir Road, Falkirk, where Bermingham lured a 14-year-old boy into the secluded surroundings before assaulting him.During the proceedings at the High Court in Edinburgh on a recent Friday, the severity of Bermingham’s actions was laid bare. The court heard that Bermingham had approached the boy while he was playing truant from school, engaging him in conversation and pretending to be a fellow student also avoiding school. Bermingham then led the boy away from the public eye, crossing a canal and climbing into a patch of bushes, where the assault occurred.
According to the prosecution, Bermingham forcibly grabbed the young boy, instructed him to sit down, and then demanded a kiss. When the boy, understandably shocked and frightened, shouted for help, Bermingham threatened him with violence, warning, “Shout and you’re dead.” The attack left a lasting impact on the victim, whose identity remains protected for legal reasons.
It was also revealed that Bermingham has a troubling history of sexual offenses. In March 2003, at just 13 years old, he was placed on the Sex Offenders’ Register after admitting to sodomising a nine-year-old boy in Callendar Woods, Falkirk. The court at that time sentenced him to three years in detention, with an extension of two years on license. Bermingham was released from custody in November 2007.
Further back, Bermingham’s family history is marred by similar criminal behavior. His father, John Bermingham, was incarcerated in 2002 for attempting to rape an 11-year-old girl walking home from dance class and for dragging an 18-year-old nursing assistant into bushes near Edinburgh’s Cameron Toll shopping centre. These attacks occurred within an hour in November 2000. Additionally, Bermingham’s older brother, William, received a five-year sentence after subjecting a teenage girl to a knife-point sexual assault. His sentence was later extended to life after he attacked a female prison officer with a homemade knife.
During the recent sentencing, Lord Uist emphasized the gravity of Bermingham’s crimes, ordering that he serve a minimum of four and a half years before being considered for parole. The court also mandated that Bermingham remain under strict supervision for the rest of his life, reflecting the ongoing concern for public safety and the potential risk posed by his release. The defense, represented by Frances McMenamin QC, argued that Bermingham had grown up in a highly sexualized environment and had struggled to learn appropriate sexual behavior. She noted that he was aware of his issues and had even suggested chemical castration as a possible solution to control his urges.
