HALIFAX MAN DUPED INTO BREACHING COURT ORDER TO VISIT EX

A man ignored a court order banning him from contacting his ex after she lied to him that it had been lifted.

The restraining order was made in June this year after Jason Isherwood was convicted of wounding the victim.

But on September 27 police were called to her Rawthorpe property following a report that the 48-year-old was there.

The caller claimed that he was living at the Brown Royd Avenue address with his former partner, Kirklees magistrates were told.

Prosecutor Lisa Evans said: “On arrival they spoke to her and she stated that he was not there.

“She then said he was and officers saw him within the property.” Isherwood was arrested and pleaded guilty to breaching his restraining order.

It was his second time in court in just a few weeks as he previously flouted the order to visit the grave of his ex's grandmother with her.

The pair visited the graveyard in Slaithwaite before going for a drink together afterwards.

The original wounding offence involved Isherwood throwing an object which caused injury to his ex.

His solicitor Daniel Metcalfe told magistrates that the victim had invited him round and there was no suggestion that he had been violent or made threats towards her.

He said: “She told him she'd spoken to his solicitor and the order had been taken away.

“That appears not to have been the case.

“He accepts it would have been prudent to have seen some paperwork before he attended there.

“He's been duped or given the false impression that the order has been taken away.” Magistrates sentenced Isherwood, of Range Court in Halifax, to a 12 month community order with 70 hours of unpaid work.

He will have to pay £85 court costs and £90 victim surcharge.

His ex has since appeared at the Huddersfield court and had the restraining order lifted on the basis that she wishes to rekindle their relationship.
