GREENOCK MAN SPARED JAIL AFTER HEADBUTTING PARTNER IN DOMESTIC ASSAULT
A violent Greenock man named Francis Kelly, aged 25, who assaulted his partner and then headbutted her in a further attack 24 hours later, has been spared jail after a court heard he is 'extremely remorseful'.Kelly, who had been in a four-year relationship with the victim, pleaded guilty to two reduction to summary offences before a trial at Greenock Sheriff Court.
The court was told that Kelly 'became aggressive' following an argument at a flat in Greenock on November 10, 2021.
Prosecutor Pamela Brady described how Kelly 'jumped up from the bed he was seated on and pushed her back against a wall and then out of the room.' The incident escalated with further physical altercation, during which Kelly pinned the woman onto the bed, causing her to urinate out of fear.
After the relationship ended that night, Kelly returned intoxicated the following day and headbutted the victim, contacting her nose and causing her to fall to the floor.
Police attended and observed swelling, bruising to her nose and a bruise to her back.
Kelly admitted to police that he had hurt his partner.
The court considered Kelly's remorse and positive background report but concluded that the level of violence over two days meant the custodial threshold was met.
Instead of jail, Kelly was sentenced to a community payback order, supervision for two years, assessment for the Up2U domestic offenders programme, and 180 hours of unpaid work within 12 months.
Additionally, a three-year non-harassment order was imposed against him.
