LINCOLN PUB SINGER JAILED FOR RAPING TWO SLEEPING WOMEN
A man named Dwane Alan Smith, aged 29 and residing on Tower Crescent in Lincoln, has been convicted of multiple counts of rape.Smith, who works as a pub singer and guitarist, was jailed for nine years at Nottingham Crown Court on November 4 of the previous year.
The court heard that he raped two women while they were asleep.
The first victim awoke to find Smith on top of her while he was raping her.
The second victim was raped nearly a year later while she was asleep after they had been involved in consensual sex.
Both incidents occurred in a bedroom above The White Hart pub in Newark.
The prosecution argued that the similar allegations from two women who did not know each other were not coincidental.
Smith denied the accusations, claiming the women fabricated the story due to shame about their actions.
However, the jury found him guilty of two counts of rape.
The trial judge did not allow the case to go forward on a third rape charge involving another woman.
Smith's defense argued that his convictions were unsafe and should be overturned, citing the judge's refusal to allow cross-examination of the victims about previous sexual experiences and to discharge the jury after the third charge was dismissed.
The appellate court, including Lord Justice Flaux, upheld the convictions, stating there was no error in the rulings and that the convictions were safe.
Smith failed to overturn his conviction on appeal.
