NOTTINGHAM SEX OFFENDER HANDED 10-YEAR ORDER FOR BREACHING ELECTRONIC DEVICE BAN
A lying sex offender wept in court as a judge sentenced him for two breaches of a sexual harm prevention order - and warned "you are in the water up to your neck".Duane Osborne, a carer for his mum, appeared in court after he breached the order at an address in Nottinghamshire.
He pleaded guilty to two offences on January 12, 2021, and May 21, 2021.
Osborne failed to make available a mobile phone, laptop, a tablet and cameras, which he used and were capable of accessing the internet.
He was banned from having them by the order made at Nottingham Crown Court on January 22, 2016.
Aged 33 and of Valley Road, Carlton, Osborne was handed a fresh sexual harm prevention order for 10 years on Wednesday (May 31).
Judge Stuart Rafferty KC told him: "You couldn't resist, in January 2021, obtaining equipment you shouldn't have had and making use of it." "Of course you were using it, otherwise you wouldn't have got it in the first place".
After lying to his supervising officer, he did the same thing again five months later.
But the judge said the delay in the case saved Osborne.
But if he had been before the judge at any reasonable time, he could have been locked up, "without batting an eyelid, because that is what you deserved," he added.
But what also saved Osborne was his mental health, although he did nothing to save himself, said the judge.
"You better understand that now you are not on thin ice, you are in the water up to your neck".
And he said Osborne was still a risk and needed to be supervised.
Sentences of 18 months in prison concurrently were imposed on both charges and suspended for two years.
He must complete 60 days of a rehabilitation requirement and an accredited programme.
