MAN JAILED FOR TRYING TO RAPE CHILD MAKES SECOND BID TO APPEAL CONVICTION AND SENTENCE
A Middlesbrough man jailed for trying to rape a child is making a second attempt to appeal his conviction and 18-year prison sentence.Nashaat, 43, formerly of Diamond Road, was found guilty of two counts of attempted rape.
In one of the sickening incidents, he tried to rape a child under the age of 13 and then again years later when she was over 16.
A single judge blocked Nashaat's initial application to appeal his conviction and sentence handed out at Teesside Crown Court in September 2023.
However, Teesside Live has learned Nashaat has renewed the application which will be reviewed at a later date in what is known as a renewal hearing.
If his application to appeal is refused again by the Court of Appeal, Nashaat may be ordered to pay costs and could receive a "loss of time order" meaning he would spend longer behind bars.
If his appeal is granted, the conviction could be overturned and/or the sentence may be reduced.
During his trial at Teesside Crown Court, Nashaat continued to deny the charges forcing his victim to give evidence.
In an impact statement, the woman, who cannot be named for legal reasons, said: "I feel it's very difficult to put into words how this case and this man Ashif Nashaat has made me feel.
"It ruined me as a person.
This will always be in my life, I just hope I have the strength to move forward." Nashaat was jailed for 11 years - one year of which to be served on extended licence - for the attempted rape of a child, and an additional eight years for the attempted rape on a person over the age of 16.
During sentencing, Judge Howard Crowson ordered that the sentences for both offences must be served consecutively.
Speaking of the second offence, he told Nashaat: "I cannot regard you as a man with no similar offending - you were simply a man who by then had not been discovered to be a sexual offender." Nashaat was also placed on the Sex Offenders' Register and made the subject of a sexual harm prevention order and a restraining order.
