A teacher involved in a controversial case related to allegations of sexual misconduct has been allowed to return to his previous teaching position at Perth High School, despite significant protests from parents and staff.The teacher, Allan Kellman, was accused of performing a sex act on a colleague, Scott Barker, while in a state of sleepwalking.
Kellman was charged with indecent assault but was acquitted after the sheriff accepted his defense that he was sleepwalking and unaware of his actions.
The incident occurred after a party, and Kellman claimed to have mental disturbances related to his service in the Gulf War, which experts believed contributed to his sleepwalking.
Although he admitted to a gay fling and his perceived sexual orientation, he was not convicted due to the sleepwalking defense.
The local council initially considered dismissing him but faced legal challenges that ultimately left them with no choice but to reinstate him.
The decision has sparked outrage among staff, particularly Scott Barker, who voiced strong opposition and threatened resignation if Kellman returned.
