PAEDOPHILE CAUGHT MAKING INDECENT CHILD IMAGES AVOIDS JAIL

A man aged 41, who produced numerous indecent images of children, is required to register as a sex offender for the next ten years.

Despite his prior convictions for similar offenses, Thomas Hayes of Chapel Croft, Rastrick, Rastrick, Brighouse, narrowly avoided imprisonment after a judge considered his efforts to change his behavior.

At Bradford Crown Court, it was revealed that Hayes, classified as "high risk" concerning potential harm, had shown signs of "remorse, shame, and self-loathing." His Honour Judge Ahmed Nadim chose to grant Hayes a chance to continue his rehabilitation.

Hayes had previously admitted to creating 70 indecent images of children across Categories A, B, and C, with Category A being the most severe.

Of these, 57 images were in Category A.

The offenses occurred between July 2022 and June 2023.

The judge sentenced Hayes to a three-year community order, emphasizing the gravity of the offenses: > "Category A images represent the gravest level of abuse involving the sexual exploitation of the youngest and most vulnerable children.

Each image is not merely a digital file.

It is the permanent record of a real child being subjected to abuse, degradation, and harm.

It is important that you understand this offending does not occur in isolation.

Those who access and make such images are not passive observers.

They are active participants in a market.

By seeking out, possessing, and making these images, you contribute directly to demand.

This demand drives the continued production of such material and, consequently, the ongoing abuse of children.

The children depicted suffer coercion, exploitation, and abuse, often enduring lifelong psychological harm such as trauma, shame, and anxiety.

The fact that these images continue to be circulated and viewed only exacerbates their suffering and prevents any real opportunity for healing." He continued: > "You pleaded guilty early on and have shown genuine remorse, shame, and self-loathing.

There has been a delay since these offenses occurred, and you have not attracted further trouble during that time.

However, this is not your first offense of this nature.

You have prior convictions from 2012 for similar conduct, for which you received a custodial sentence.

This history demonstrates your awareness of the criminality and harm involved, yet you reoffended.

The probation service’s assessment describes you as presenting a high risk of harm, which is a serious concern.

Given these circumstances, I could rightly impose a prison sentence." However, Judge Nadim was persuaded to give Hayes a chance to build on the progress he had made in addressing his behavior and expressed his willingness to "invest trust" in his rehabilitation.

Along with the community order, Hayes was ordered to complete 30 days of rehabilitation activities, and he will be subject to a six-month electronically monitored curfew from 10pm to 7am.

A Sexual Harm Prevention Order will remain in effect for 10 years, and Hayes will need to register as a sex offender for the same period.

The judge concluded: > "I am offering you an opportunity to show that you have genuinely learned from your past actions and this process.

If you fail to do so, you will be sentencing yourself to prison.

No further leniency will be granted."
