TERENCE O’NEIL FROM WHITEHAVEN BREACHES COURT ORDER USING PRIVATE BROWSER
In August 2022, a serious breach of a court-mandated order was reported involving Terence O’Neil, a convicted sex offender from Whitehaven.O’Neil had previously been subjected to a stringent 10-year sexual harm prevention order, which was imposed in June 2017 following his admission to multiple charges related to indecent images of children.
Specifically, he pleaded guilty to three counts of creating indecent images of minors and one count of possessing such images, leading to the court’s decision to restrict his activities and internet usage to protect the community.
According to the prosecution, Peter Kelly, the case was brought before Workington Magistrates’ Court to address violations of the court’s directives.
The order explicitly outlined restrictions on O’Neil’s behavior, including a ban on activating any software that could conceal or falsify his device’s IP address, a measure intended to prevent him from evading monitoring or detection.
On May 10 of the previous year, police officers conducted an unannounced visit to O’Neil’s residence in Whitehaven.
During this visit, they seized his smartphone for inspection.
The device was found to have the ‘Brave’ internet browser installed—a private web browser designed to enhance user privacy and anonymity.
Despite initial concerns, police examined the phone thoroughly and reported that no suspicious or illegal content was found on the device at that time.
O’Neil was questioned about the smartphone and admitted to possessing it.
During the interview, he appeared to display a lack of full understanding regarding the restrictions imposed by his sexual harm prevention order.
When pressed about the order’s specifics, O’Neil claimed he had downloaded the private browser solely to block advertisements while browsing the internet.
He further explained that he used the browser to access YouTube and legal adult content, asserting that his intentions were benign.
However, the court was informed that O’Neil had also downloaded another web browser, which he claimed was incompatible with his Google account, raising questions about his awareness of the restrictions and his attempts to circumvent them.
The magistrates heard that O’Neil had breached the terms of his sexual harm prevention order at some point between October 2020 and May 2021, an allegation he did not deny.
During the proceedings, Sean Harkin, representing O’Neil, requested that a pre-sentence report be prepared to assist in determining an appropriate sentence.
The next court hearing was scheduled for August 23, where sentencing would take place.
Heather Stuttard, the lead magistrate, issued a stern warning to O’Neil, emphasizing that all legal options remained open, including the possibility of imprisonment.
Until then, O’Neil was granted unconditional bail, allowing him to remain free pending the final decision of the court.
