The judge pointed out that James had not only viewed child pornography but also expressed intentions and fantasies about abusing children, which he had carried into reality in the past.

The court noted that James’s case exemplified a persistent risk, and therefore, his detention was justified.

It was made clear that James would remain in custody until he could convincingly demonstrate to the Parole Board that he no longer posed a threat.
