BLACKBURN MAN CAUGHT BREACHING RESTRAINING ORDER AT GIRLFRIEND'S HOUSE
A man named Simon Chinery, aged 31 and of no fixed address, appeared before Blackburn magistrates after he was caught at his girlfriend's house in Brodick Road, Blackburn, in breach of a restraining order.The incident occurred when Chinery opened the door to police dressed only in his boxers, claiming his partner had invited him over and told him the restraining order had been lifted because she retracted her statement.
Chinery pleaded guilty to breaching the restraining order, which was initially made in February alongside a suspended prison sentence.
He was sentenced to 12 weeks in prison, suspended for 12 months, and ordered to pay a £120 victim surcharge along with £85 in costs.
Prosecutor Catherine Allan stated that Chinery had previously been subject to the restraining order and a suspended sentence.
Defense lawyer Damien Pickup said Chinery's actions stemmed from a chance encounter with his former partner, who convinced him to come around, falsely claiming the restraining order had been removed.
Chinery believed her but was naïve in not verifying.
The court highlighted that although he had breached the order once before, it was not active at the time of this breach.
