    In a disturbing incident that has raised serious concerns about the oversight of convicted sex offenders, Robert Edwards, a 62-year-old resident of Eyemouth, found himself at the center of a legal controversy after being left alone in charge of a one-year-old child in Jedburgh. The court proceedings revealed that Edwards, who was under a Sexual Offences Prevention Order (SOPO) that explicitly prohibited any contact with children, had violated the strict terms of his release just days earlier.

    The incident took place on a Wednesday in Jedburgh, where Edwards had been invited to stay at a friend’s house shortly after his recent release from prison. According to the court, the friend, along with another woman who was with her and had the child in her care, decided to leave Edwards alone in the house while they went to Hawick. It was during this period that social workers received information indicating that Edwards was alone with the child, prompting immediate police intervention.

    Prosecutor Graham Fraser explained that Edwards had been unaware that the child's mother was also in the house or that the women intended to leave for Hawick. He described the breach as particularly egregious, emphasizing that Edwards had a prior conviction for assaulting a child of a similar age. The court heard that Edwards had only recently been released from prison, having served a sentence for previous offenses, and that this latest breach was a significant violation of the restrictions placed upon him.

    During the hearing at Selkirk Sheriff Court, Edwards admitted to breaching the terms of his SOPO. The court was told that social workers had been tipped off about the situation, which led to police being called to the scene. Defence lawyer Fiona Hamilton argued that Edwards believed the child was under the supervision of a neighbor, who was unable to watch the child at that moment. She also stated that Edwards thought the women were only going to a nearby shop for a brief period of about 20 minutes and was unaware they had plans to go to Hawick.

    Ms. Hamilton emphasized that Edwards had made efforts to comply with the restrictions and that there was no malicious intent or premeditation involved. She remarked, “He did not want to say no,” suggesting that Edwards was trying to follow the rules but was misled about the situation.

    In sentencing, Sheriff Peter Paterson imposed a jail term of 80 days for the breach. Additionally, he sentenced Edwards to a further 120 days to account for an unexpired portion of his previous prison sentence, which had been shortened through early release. This was not Edwards’ first encounter with the law; earlier this year, he was convicted and sentenced to 12 months in prison after a jury at Selkirk Sheriff Court found him guilty of engaging in inappropriate contact with two young children at a bus stop. The court also found that Edwards had offered money and sweets to the children during a bus journey between Berwick and Eyemouth, actions that further violated the conditions of his Sexual Offences Prevention Order.

    The case underscores ongoing concerns about the monitoring and management of convicted sex offenders, especially those with a history of offenses involving children. The authorities continue to emphasize the importance of strict adherence to legal restrictions to prevent such breaches and protect vulnerable members of the community.
