ROBERT DONNACHIE FROM DUNDEE AND MONIFIETH ESCAPES PRISON AFTER POSSESSING OVER 1,600 CHILD INDECENT IMAGES

In a case that has shocked the local communities of Dundee and Monifieth, Robert Donnachie, a 34-year-old man with ties to both areas, has been spared a prison sentence despite possessing an alarming collection of more than 1,600 indecent images of children. The incident, which came to light in February 2016, involved the discovery of these images on Donnachie’s devices, with the majority classified as Category C under the Sexual Offences Definitive Guideline, indicating a significant level of severity.

At the time of the hearing, Donnachie, who resides on Park Avenue in Dundee and has previously lived in Monifieth, admitted to the possession of these illicit materials. The case was brought before Forfar Sheriff Court, where the judge faced the challenging task of determining an appropriate sentence given the defendant’s attitude and personal circumstances. The court was informed that Donnachie’s conduct and mindset posed difficulties in considering a custodial sentence, leading to a decision to defer sentencing for three months to allow for further assessments.

During the proceedings, defence solicitor Billy Rennie highlighted Donnachie’s social discomfort and the fact that he is an educated individual holding a degree in architecture. Rennie explained that Donnachie’s social interactions and overall demeanor made him a difficult case for rehabilitation programs. The solicitor also revealed that Donnachie had not presented well to social workers but expressed an understanding of the harm caused by the dissemination of such images, even if this remorse was not fully evident in the reports.

Rennie further stated that Donnachie had withdrawn from his family, friends, and normal social life in relation to these matters, indicating a level of personal distress. The court was shown a letter from Donnachie, in which he reportedly gave serious consideration to his actions and the impact of his offending. While the defendant did not intend to minimize the seriousness of his crime, the reports and his presentation to social workers did not reflect this remorse.

Ultimately, Sheriff Murray decided on a community-based disposal, imposing a three-year Community Payback Order. This included 200 hours of unpaid work, which is the maximum permissible given Donnachie’s early plea. Additionally, his name will be entered onto the Sex Offenders’ Register for the duration of the order. Conditions attached to the order prohibit him from having any contact with individuals under 16 without prior approval and restrict his possession of devices capable of accessing the internet unless supervised, with passwords and serial numbers available to authorities.

Despite the severity of the offence, the court’s decision reflects a complex balance between punishment, rehabilitation prospects, and the defendant’s personal circumstances, leaving the communities of Dundee and Monifieth to grapple with the implications of this case.
