SHOPPER SLAPPED ON BUM BY DRUNK IN ANGUS STORE - ORDERED TO PAY £500
A drunk man who slapped a shopper’s bum in an Angus Scotmid has been ordered to pay her £500 compensation.Peter Davies, 53, of Rosemount Road in Hillside, returned to the dock at Forfar Sheriff Court to be sentenced, having previously admitted the sexual assault at the store on Newmanwalls Avenue in Montrose on April 26 last year.
Sheriff Derek Reekie noted that after the incident, “deflecting” Davies was heard to say: “I couldn’t help myself, I’m an a***hole, people can’t take a joke anymore.” However, the sheriff took issue with the tale Davies spun in a pre-sentencing report that he offender mistook his victim for another person he knew.
His solicitor Nick Markowski said: “He’s got a diagnosis of schizophrenia and significant mental health issues but he’s been out of trouble for 20 years.
“It appears he was at the shop, he was disinhibited by the effects of alcohol and that he slapped the buttocks of a stranger to him.
I think she was doing her shopping and bent down in front of him.
“He accepts his behaviour was not appropriate and should not be tolerated.
“He does have an eyesight issue – alcohol was the feature in this particular incident.
“He thinks the complainer should be compensated.
It was an isolated incident.” Sheriff Reekie placed Davies on the sex offenders register and under supervision, each for a year and said: “I was disappointed to see what you said in the report, it seems to me you were perhaps trying to deflect some responsibility.
“I’m sure that you accept the behaviour was inappropriate.”
