COWDENBEATH MAN SENTENCED FOR SEXUAL ASSAULT ON ELGIN HIGH STREET
A man who seized an unknown 19-year-old woman's buttocks while on a night out has been placed on the sex offenders register.Paul Neilson, aged 44 and from Cowdenbeath in Fife, was also ordered to complete unpaid work during his sentencing at Elgin Sheriff Court yesterday.The incident occurred on Elgin High Street last June, with Neilson previously admitting to sexually assaulting the 19-year-old by seizing her buttocks.
The official charge states that he "did seize hold of her buttocks" on June 29, 2024.Elgin Sheriff Court was told that Neilson pleaded guilty after CCTV footage confirmed the offence took place.
Fiscal depute Karen Poke explained that Neilson had been out with friends on a Saturday night when the incident happened.
Around 2 am, the complainant was standing outside Downtown, looking towards the taxi rank, when Neilson approached her, seized her bottom, and walked around her on the left side.The woman then pursued Neilson, leading to an altercation that police attended.
Neilson was initially removed from the area but was later found at a nearby Travelodge where he was staying.
He made no reply when cautioned and charged.Neilson's solicitor, Stephen Carty, stated that his client was heavily intoxicated at the time and described his actions as a "drunken, spur of the moment thing." He added that Neilson had not known the woman's identity or age and that he approached her from behind.
The solicitor noted that a background report on Neilson was positive and that the incident was a matter of regret, describing it as a "drunken, silly decision." He also mentioned that Neilson's relationship had ended as a result of this matter.In sentencing, Sheriff Pasportnikov ordered Neilson to undergo nine months of social work supervision, complete 120 hours of unpaid work, and register as a sex offender for nine months.
