MAN SENTENCED OVER ‘FRIGHTENING’ BEHAVIOUR TOWARDS FORMER PARTNER

A student who sent his former girlfriend a photo of himself holding a 'zombie knife' and refused to leave her doorstep has received a sentence for his intimidating conduct.

During his appearance at Elgin Sheriff Court, Oliver Martin pleaded guilty to knocking on his ex-partner’s door and shouting, as well as failing to provide a breath sample during a drink-driving test.

He was sentenced to community service, instructed to avoid any contact with his former partner, and prohibited from driving for one year.

The court was informed that Martin had previously been in a long-term relationship with the victim, with the couple living together until their separation in 2024.

Prosecutor Shay Traynor explained that despite their breakup, the pair maintained what was described as an "amicable friendship." However, on the evening of August 6 last year, Martin sent a photograph to his ex showing him holding a 'zombie knife.' Mr Traynor noted that the message caused the woman to experience significant concern, but she chose not to report it to police at the time, citing Martin’s mental health issues.

He further stated that she believed the image was sent with the intent to frighten her.

Later, on September 18, while at her home, the woman received a message from Martin in which he asked to visit her.

Although she declined his request, she then heard him shouting and banging on her door around 10:40 pm.

According to Mr Traynor, the woman thought Martin was intoxicated and called the police when he refused to leave her property.

Police traced him shortly afterward and took him to Elgin Police Station, where he failed to conduct a required alcohol test and was detained overnight.

Defence solicitor Grant Daglish stated that Martin, now residing on the Isle of Bute, is an "intelligent individual" aware of the effects his mental health and alcohol use can have.

He explained that Martin was experiencing a manic episode during the incident, which impaired his judgment, and was having difficulties managing his medication.

Mr Daglish mentioned that Martin apologized to his ex-partner and sought help for his mental health, including time spent in hospital.

He added that Martin is a student working towards completing his studies after his health improves.

Sheriff David Harvie commented that the incident must have been frightening for the victim, especially after receiving threatening messages and then having him show up unannounced.

Martin admitted to charges of threatening or abusive behavior by sending messages and visiting her property against her wishes, as well as failing to provide a breath sample during the police investigation.

He was sentenced to 180 hours of unpaid work, banned from driving for one year, and placed under social work supervision for one year.

Additionally, he was ordered to stay away from his former partner for a three-year period.
