PERTH MAN GETS COMMUNITY ORDER AFTER HEADBUTTING WOMAN OUTSIDE FITTIE BAR
A man named Martyn Shaw, aged 35, committed an assault outside the Fittie Bar after a daytrip to Perth Races.The assault involved Shaw head-butting a woman, which resulted in her front teeth being shattered.
The victim, who was 'badly affected' by the attack, will need approximately two years of dental treatment to restore her teeth.
According to court reports, Shaw fell out with the woman on the return bus journey, during which he told friends, 'She’s getting it when she’s off the bus,' and then spat in her face.
The altercation escalated when Shaw approached the woman outside the bus and head-butted her without provocation, causing her to fall onto the cobbled street and bleed from her mouth.
She was taken to Aberdeen Royal Infirmary and attended an emergency dentistry clinic where she was found to have two shattered front teeth near the root.
Shaw pleaded guilty to two charges: the assault involving the head-butt and spitting on the woman.
The court considered his actions and his remorse, leading to a sentence other than prison.
Instead of jail, Shaw was given a community payback order with supervision for 18 months, ordered to perform 180 hours of unpaid work, be on a nine-month restriction of liberty order, and pay his victim £750 in compensation.
Sheriff Christine McCrossan highlighted that Shaw had served the equivalent of a 10-month sentence already and stated she did not believe it was premeditated.
The case emphasizes the violent nature of the assault and its impact on the victim, along with the court's consideration of Shaw's remorse and circumstances.
