MARTIN BENSON FROM HODDESDON ESCAPES JAIL AFTER DOWNLOAD OF CHILD INDECENT IMAGES
In April 2021, a man from Hoddesdon named Martin Benson faced serious allegations related to the possession and download of indecent images of children. Benson, who resides on Plomer Avenue in Hoddesdon, was found to have accumulated a significant collection of illegal material, including some of the most severe categories of such images.Specifically, Benson was discovered with 24 images classified as 'Category A,' which are considered among the most serious due to their explicit and penetrative content involving young children. The images included depictions of sexual acts involving minors, which heightened the severity of the case. Benson was brought before St Albans Crown Court to face these charges, where he ultimately pleaded guilty to three counts of making indecent images of children.
The court proceedings revealed that the illegal images were downloaded over a period stretching from November 18, 2018, to September 18, 2019. During this time, Benson's mobile phone was seized following a police search warrant executed on September 19, 2019. The authorities found the illicit material stored on his device, prompting his arrest and subsequent charges.
During police interviews, Benson explained his actions by stating that he was in 'a bad place' emotionally, citing his struggle with multiple sclerosis as a contributing factor. Prosecutor Michael Speak from the Crown Prosecution Service (CPS) noted that Benson initially refused to comment during his first police interview but later changed his stance in a subsequent interview. Benson expressed feelings of self-disgust, telling officers that he was 'disgusted with himself.'
Further investigation revealed that Benson's online activity had initially involved accessing adult material, but he later began to view and download images of young girls, including those depicting sexual acts. The court was informed of the full extent of his downloads, which included 39 images classified as 'Category B' and 130 as 'Category C.'
Judge Foster, presiding over the case, addressed Benson directly during sentencing. He emphasized the gravity of the offense, stating, 'You are disgusted with yourself and so you should be. These are real people, not just images on a screen, and they suffer because of actions by individuals like you.' The judge highlighted the vulnerability of the victims, often from impoverished backgrounds, and condemned the market for such illegal material.
While the judge acknowledged that the possession of images depicting penetrative sexual activity could have warranted an immediate prison sentence, he chose to impose a more lenient sentence due to Benson's remorse and efforts to seek help. Benson had self-referred for further psychological support and demonstrated genuine remorse for his actions. Consequently, Judge Foster sentenced him to eight months in prison, suspended for 18 months, allowing him to avoid immediate incarceration.
In addition to the suspended sentence, Benson was subjected to a range of restrictions and requirements. He will be subject to a Sexual Harm Prevention Order for ten years and will be registered as a sex offender for the same period. He is also mandated to complete 30 days of rehabilitation activities and perform 200 hours of unpaid community work within 18 months. His mobile phone was confiscated and is set to be destroyed to prevent further misuse.
Overall, the case underscores the ongoing efforts of law enforcement to combat the distribution and possession of illegal images of children, and the importance of judicial discretion in cases involving remorse and efforts to reform.
