2008: MAN JAILED AFTER PUNCHING BACK OF PUSHCHAIR WITH THREE YEAR OLD CHILD INSIDE
A young man, aged 19, received a sentence of ten weeks in a young offenders’ institution after he assaulted a man, failed with his punches, and accidentally struck a stroller containing a three-year-old child.Mark Payne-Lundy’s aggressive reaction began after he shouted at two people whom he believed had spread malicious rumors about him.
During a court session in Worcester on Wednesday, Payne-Lundy, who lives on Skiddaw Close in Warndon, admitted to provoking harassment, fear, or distress through his words or actions, which could lead to the use of unlawful violence.
Prosecutor Mark Johnson told the court that on July 9, Payne-Lundy approached a couple pushing a stroller.
He recounted that Payne-Lundy began shouting at Matthew Frost, who responded by saying he did not want to argue because his three-year-old son was nearby.
Mr.
Johnson explained that Payne-Lundy told Frost, “I don’t care if your kid’s here or not, I’m going to put one on you.” He threw three punches—two aimed at Frost’s head, which missed after Frost ducked, and a third aimed at Frost’s ribs, which hit the back of the stroller when Frost moved quickly away, waking the child inside but not causing distress.
Following the confrontation, Payne-Lundy left the scene shouting, “I’ll be waiting for you outside school.” Defense solicitor Rob Macrory noted that his client was about to begin a new job and that positive aspects of his life seemed to be in place.
However, District Judge Bruce Morgan emphasized Payne-Lundy’s unacceptable behavior on the night of the incident and referred to his previous convictions, including battery, as justification for the custodial sentence in a young offenders’ facility.
