KIM AVIS SENTENCED TO 15 YEARS IN PRISON FOR RAPE AND SEXUAL ASSAULT IN INVERNESS AND GLASGOW

A convicted rapist who attempted to escape justice by fleeing across the Atlantic to the United States has been sentenced to a significant prison term of 15 years.

Kim Avis, age 57, was found guilty of three counts of rape and one count of sexual assault following a detailed trial conducted at the High Court in Glasgow last month, according to the Crown Office.

The court revealed that Avis was held responsible for a total of 14 charges.

The majority of these offences occurred in the city of Inverness, spanning a period from 2006 to 2017.

These allegations included serious sexual crimes, among them his failure to attend a scheduled trial date after he had fled to the United States to evade detection and accountability.

Avis’s daring attempt to escape justice was only partially successful.

He was detained in Colorado Springs, Colorado, by the US Marshals Service in July 2019.

His disappearance initially raised alarms in February of that year, when he was reported missing after going swimming at Monastery Beach in Carmel, California.

It was subsequently discovered that Avis was on bail for previous offences committed in Scotland, which added a layer of complexity to the investigation.

The extradition process brought Avis back to the United Kingdom, where he faced the criminal justice system.

He appeared before the High Court in Edinburgh on a Friday and received his sentence.

Fraser Gibson, the procurator fiscal responsible for sexual offences at the High Court, commented on the case, acknowledging the difficulty of the investigation and praising the victims for their bravery in coming forward.

He emphasized the collaborative effort among police, prosecutors, and US law enforcement agencies that led to Avis’s apprehension and eventual sentencing.

Under the terms of his punishment, Avis received a prison sentence of 12 years for the sexual offences — which included multiple acts against children as well as a rape — and an additional three years for the offence of failing to attend court after fleeing abroad.

The court detailed that the trial had been scheduled for March 11, 2019.

However, after experiencing a near-death episode in California, Avis believed he would not receive a fair hearing in Scotland and chose not to return.

This led to him being on the run for several months.

US authorities did not believe Avis was deceased and actively tracked him down in Colorado.

His extradition back to the UK ensued, and he was formally charged and convicted on multiple counts of sexual offences spanning over a decade, from 2006 to 2016.

Despite his convictions, Avis continued to deny the allegations, maintaining his innocence throughout the proceedings.

In addition to his criminal activities, Avis was known locally as a street trader in Inverness and was recognized with a good citizen award at one point.

Nevertheless, his criminal record now includes 13 counts of sexual misconduct, with the court also acknowledging his guilty plea on one additional offence, which resulted in a slightly reduced sentence of three years for that particular charge.

Police Scotland’s Detective Inspector Caine McIntyre from the domestic abuse task force expressed his support for the victims in this case.

He praised their resilience and courage during the lengthy investigation and court process.

McIntyre also took the opportunity to urge anyone suffering from domestic or sexual abuse to report their experiences.

He emphasized that it is never too late to seek help and advised victims to reach out to the police or support organizations such as Women’s Aid and Rape Crisis Scotland to access guidance and assistance.

This case underscores the importance of relentless justice efforts and international cooperation in addressing heinous sexual crimes.

The conviction and lengthy sentence serve as a stark reminder of the severity with which such offences are treated in Scotland.
