2007: WOMAN IS JAILED FOR RAPE CLAIM
Kerry Thomas, a woman from Netherton, has been sentenced to 32 months behind bars after falsely claiming she had been raped following sex with a man in an alleyway.The 38-year-old, residing on Crescent Road, admitted to attempting to derail justice by misleading authorities when asked about her alleged assault, especially after two men were detained during an extensive police operation.
In subsequent interviews, she revealed that her previous statements were fabricated, describing her actions as a cry for help.
Prosecutor Sati Aujla outlined to the court that Thomas initially asserted she had consensual intercourse in an alley next to an Indian restaurant in Dudley, West Midlands.
Staff members at the restaurant, who observed the encounter, found the situation somewhat amusing.
After the incident, Thomas experienced feelings of anger and embarrassment and falsely claimed she had been raped, leading police to launch a broad investigation.
One man was arrested in view of colleagues and customers at the restaurant, detained for approximately five and a half hours, and subjected to a medical examination.
Despite maintaining her original rape claim, Thomas later agreed to a press release, which resulted in identifying and detaining the man involved, who was held for two hours.
Defence solicitor Miss Blondelle Thompson explained that Thomas had attended a birthday party, consumed alcohol, and later engaged in sexual activity in the alley.
She added: “She was upset because people had been watching her and, in her drunken and embarrassed state, she falsely accused someone of rape.” At Wolverhampton Crown Court on November 21, Recorder Derek Chinery highlighted that law enforcement had allocated considerable resources to finding a rapist during a period when their capacity was stretched dealing with other serious crimes, including firearms offences.
He pointed out that two men had been detained, one of whom lost his employment after a very public arrest at his workplace.
The judge condemned the false report as a serious matter that hampers efforts to support actual victims of rape and emphasizes the importance of honesty within the criminal justice system.
He noted that Thomas's deception began with a blatant lie and was sustained over several days, complicating investigations.
