JOHN TAYLOR
The 42-year-old pleaded guilty to sexually assaulting the woman while she was intoxicated and carrying out a sex act on September 8, 2020.
He was sentenced in June 2024 to a community payback order (CPO) including unpaid hours of work and social work supervision.
But he failed to do what was ordered and got locked up to await resentencing.
He appeared from custody at Dumbarton Sheriff Court on April 29.
Sheriff James Mulgrew noted Taylor had been in custody for a couple months awaiting sentencing.
He had a limited criminal record but he had questions about where he would stay.
Defence solicitor Scott Adair said his client had an address in Shotts that was still available to him.
Court papers from more than a year ago listed an address in Mafekind Street, Wishaw.
He explained that Taylor was being asked to travel to Wishaw to meet with social workers and for his unpaid work, requiring bus journeys twice a week.
A new arrangement would allow him to "attend for unpaid work and then see supervising officer so it will only be one journey a week", he said.
Mr Adair said there had been a "downturn" in his client's mental health but his time locked up allowed him to "detoxify".
He was previously living in Drumchapel, heard the court.
Sheriff Mulgrew said: "You were placed on a CPO for a serious offence.
The CPO has not gone well.
"It seems if you engage, you would do well." Taylor was put on a new CPO with supervision for two years, 200 hours unpaid work within a year, and a review on May 23.
He was already on the sex offenders register but that has been reimposed for two years.
