ABERFELDY MAN WALKS FREE AFTER ASSAULT WITH SAUCEPAN
A man named John Phillips has been sentenced to a 10-month jail term for physically assaulting his partner.According to Perth Sheriff Court, Phillips struck his partner on the head with a saucepan and then proceeded to punch her multiple times while she was on the kitchen floor.
The incident occurred on July 27 of the previous year at her residence in Aberfeldy.
The court heard that Phillips, who hails from Crieff, reacted violently after she initially hit him with a saucepan.
During the court hearing, Phillips admitted to the indictment of assault causing injury to his partner.
He was informed that prison time was deemed appropriate for the assault but was not incarcerated as he had already served his sentence on remand.
The incident resulted from an argument during which the woman attacked Phillips first, and he retaliated with violence, including hitting her with a saucepan and punching her, which caused a large hematoma on her forehead.
She was taken to hospital for assessment, and officers arrived shortly after the incident to arrest Phillips in the living room.
The defense pointed out that the victim was extremely upset that day and attacked Phillips first, and the period he had spent in custody was sufficient punishment.
The court considered their reconciliation and confirmed that no non-harassment order was necessary.
Sheriff Alison McKay emphasized that although Phillips had previous convictions, none were for violence, and this case was seen as a one-off offense.
The sheriff also indicated that custody was the appropriate penalty, with the sentence being backdated to July 29 when Phillips was first remanded.
The court decision included that a non-harassment order was not justified.
