JAMES STRAIN BANNED FROM BELFAST AFTER CHILD IMAGE OFFENSES

In November 2012, a serious case involving a man from east Belfast was brought before Belfast Crown Court, highlighting the disturbing issue of child exploitation and online abuse.

The defendant, 61-year-old James Strain, was found to have downloaded over 1,000 indecent images depicting children being subjected to abuse.

Furthermore, he engaged in swapping many of these images with others, demonstrating a disturbing pattern of behavior that raised significant concern among law enforcement and the judiciary.

During the court proceedings, Judge Corinne Philpott QC addressed Strain directly, emphasizing the gravity of his actions and the distorted attitudes that underpinned his offending.

She ordered him to participate in a specialized internet sex offender’s treatment program, aiming to address the underlying issues that led to his criminal conduct.

The judge made it clear that her primary concern was the impact on the victims, stating, “The natural concern the court has in this type of offending is that the child victims are not seen as victims, that just because they have not been touched or interfered with by this defendant doesn’t mean that they have not suffered.” Strain was also ordered to sign the police sex offenders register for the next five years, a measure intended to monitor and restrict his activities.

The judge warned him that any breach of his probation conditions would result in a custodial sentence of 18 months, underscoring the seriousness with which the court viewed his actions.

The case took a disturbing turn when police officers executed a search warrant at Strain’s residence, located at Parklands in east Belfast.

During the search, they seized a computer and an external hard drive, uncovering a total of 1,156 indecent images of children being abused, including some involving bestiality.

Prosecutor Philip Henry informed the court that while most of these images fell into the lower categories of one to three, there were also a number classified in categories four and five, indicating more extreme content.

Further investigation revealed that Strain had created eight different online identities, which he used to engage in chatroom conversations across the internet.

All but one of these identities were used to pose as a teenage girl, a tactic that facilitated his exchange and acquisition of illicit images.

Strain admitted to swapping some images and obtaining others through these online aliases, demonstrating a calculated effort to conceal his activities.

He pleaded guilty to a total of 15 charges related to indecent images of children, including three counts of distributing such images and three counts of possessing extreme pornography.

These offenses spanned from January 31, 2009, to June 14 of the previous year, reflecting a prolonged period of offending.

During the hearing, defense counsel John McCrudden explained that Strain, who relies on a wheeled zimmer frame due to arthritis, initially began viewing adult pornography online.

However, he argued that “like soft drugs it was the gateway to this sort of filth,” suggesting that his initial curiosity escalated into more serious criminal behavior.

In delivering her sentence, Judge Philpott acknowledged the difficulty the public faces in coming to terms with such heinous crimes.

Nonetheless, she noted that Strain had pleaded guilty, expressed remorse, and was not deemed to pose an ongoing risk to the community.

As a result, she imposed a probation order combined with the requirement to undergo treatment, aiming to rehabilitate rather than solely punish the offender.
