MAN SPARED JAIL AFTER SICK STASH REVEALED
A man from South Tyneside was discovered with heinous child abuse images stored on his phone’s SIM card after an investigation by the UK’s national police agency, a court was informed.James Marshall, aged 31, was found asleep at his residence on Bunyan Avenue, Biddick Hall, during a police raid on September 7, 2022.
The raid was initiated based on information from the National Crime Agency, which uncovered disturbing images on a SIM card within a Samsung mobile phone.
At the South Tyneside Magistrates’ Court, Marshall pleaded guilty to three counts of producing indecent photographs or pseudo-photographs of children.
He also admitted to possessing an extreme pornographic image showing a sexual act involving a dog.
Although he confessed, Marshall maintained that he came upon the images accidentally.
He was given a six-month jail sentence, suspended for two years, and was subjected to two sex-offender treatment orders lasting ten years.
Prosecutor Clare Irving stated: “Officers executed a search at his home and made arrests in connection with allegations of uploading child abuse images.
Law enforcement found the defendant asleep and recovered a mobile phone, a USB stick, and an Xbox console.
Another phone, a Nokia, was found in a separate room.
This case originated from an inquiry by the National Crime Agency involving a SIM card taken from a Samsung device.
The defendant did not respond during police interviews.” Law enforcement identified up to seven images as most severe Category A, with additional images in categories B and C.
District Judge Zoe Passfield told defense attorney Chris Wilson that Marshall “believes he stumbled upon the images inadvertently.” Mr.
Wilson noted that Marshall had acknowledged his guilt and was prepared to participate in rehabilitative efforts.
He emphasized Marshall’s remorse and indicated his lonely lifestyle may have contributed to his actions.
The lawyer stated: “He accepts responsibility and can be rehabilitated, according to the Probation Service.” The judge suspended the sentence, ordering 40 days of rehabilitation activities, and imposed registration and restrictions under the Sexual Offences Act for ten years.
Marshall was also ordered to pay a victim surcharge and court fees, and his electronic devices are to be confiscated and destroyed.
