ANGUS MAN JAILED FOR SEX ASSAULT AFTER SNEAKING INTO SLEEPING WOMAN'S HOME
A man named James Du-Tracy from Letham in Angus has been sentenced to 18 months in jail after pleading guilty to sexually assaulting a sleeping woman.The incident occurred after he had previously made an unwanted pass at her in June of the previous year, which she rebuffed.
The court heard that Du-Tracy sneaked into her home while she was asleep on her sofa with her child nearby in a pram.
She awoke at around 1:10 AM when she heard her child crying and discovered she was being sexually assaulted.
During the hearing, the prosecution revealed that the woman had refused any consent to sexual contact earlier that day.
Despite her initial reluctance, Du-Tracy tried to apologize and claimed he was very drunk, which he stated led to the misunderstanding.
His defence argued that he had self-reported the incident to police and showed remorse immediately afterward, believing it was a total misconception on his part.
The sheriff emphasized that an asleep woman cannot give consent, particularly since she had previously declined all forms of sexual contact earlier in the day.
Du-Tracy was also ordered to be on the sex offenders register for ten years.
The court described the incident as a serious breach of trust and personal boundaries, concluding that the woman could not have consented at the time of the assault.
