LLANELLI MAN AVOIDS PRISON FOR SHARING INDECENT IMAGES OF CHILDREN DUE TO POLICE DELAY
A self-confessed paedophile who shared images of young girls being raped has avoided immediate prison because police took so long to charge him.Despite Gethin Samuel making admissions to officers on the day he was arrested, it took police almost three-and-a-half years to formally charge him.
A judge at Swansea Crown Court stated that if the case had been dealt with promptly, he could not have avoided prison, and called the delay "about as astonishing a failure as I have seen".
Prosecutor Dean Pulling explained that on February 8, 2022, police executed a search warrant at Samuel's home in Llanelli and seized electronic devices, including an iPhone.
During the search, Samuel told officers he believed they were there because of his activities on the messaging app Telegram, where he claimed a "Portuguese man" had been sending him images.
The iPhone was examined and found to contain 169 indecent images, including 63 Category A images, some of young girls as young as four being raped.
Samuel admitted to having a sexual interest in children since the age of 12 and to viewing indecent images, sharing such images with others, and possessing them.
He had pleaded guilty to multiple counts of making and distributing indecent images of children.
He has no previous convictions.
Samuel, aged 41, was sentenced to two years in prison, suspended for two years, and will be a registered sex offender for 10 years.
He was also subjected to a sexual harm prevention order for 10 years.
The judge emphasized that the victims were real children suffering ongoing abuse, and stated that the delays in case processing actually benefited Samuel by allowing him to rehabilitate.
He also warned that if the case had been handled more swiftly, the outcome might have been different, highlighting the judicial failure involved.
