2014: A SEX FIEND JAILED AFTER RAPING WOMAN IN BROAD DAYLIGHT IN ROWLEY REGIS
A man known for his sexual offenses has been sentenced to eight years in prison after raping a woman in Rowley Regis who was so intoxicated that she was unable to move or speak.Jamaican national Gerald Malcolm, aged 48 and without a fixed address and currently unemployed, committed the assault on a public grass verge during daylight hours.
Malcolm encountered a 28-year-old woman from the local area at a public library and later suggested they visit a pub in the afternoon.
He bought her a drink, then invited her back to his home, where she became ill from alcohol consumption.
Although Malcolm accompanied her part of the way home, she has no recollection of this event.
At approximately 4:10 pm, during broad daylight, witnesses observed a couple engaged in sexual activity on a grass verge on Hanover Street, Rowley Regis.
One bystander even attempted to intervene by pouring water on the couple.
Malcolm fled the scene; when the witness expected the woman to stand up, she remained on the ground.
Subsequently, he went to her aid along with his mother, and they remained with her until police arrived.
Laboratory tests revealed her blood alcohol level was more than three times the legal limit for drink-driving, with a forensic scientist noting that such levels would result in severe intoxication for an average person.
Malcolm admitted guilt during his first court appearance, and after sentencing, steps toward deportation will commence.
The woman, whose identity is protected for legal reasons, expressed her distress: "The assault has had a lasting impact on me; I still can’t believe this man attacked me, and I don’t understand how I became so drunk.
It’s terrible that I don't remember what happened—the incident occurred in the street during the daytime.
I would never do anything like this in public.
I keep blaming myself, thinking it’s my fault because I was so intoxicated, but he shouldn’t have done this.
He shouldn’t have taken advantage of me." She further stated, "I couldn’t move or speak properly, let alone resist or say no.
I went with him for a drink but never consented to sex—nothing like that was on my mind." Detective Constable Sarah West from the Public Protection Unit commented on the case: "Rape is rape, and there are no justifications or gray areas.
Men must understand that if a woman says no or cannot consent—due to drinking or drugs—they are committing a crime.
I hope today’s sentence will help the victim move forward, knowing the offender is behind bars."
