SICK PERVERT GARY MITCHELL JAILED FOR SEXUALLY ATTACKING DRUNK WOMAN
A man has been jailed for 30 months for sexually assaulting a drunk woman while her friend went to get her a sick bowl.The victim, who considered Gary Mitchell a "friend", had bumped into him while she was on a night out with a female friend, Hull Crown Court heard.
When the women parted company with Mitchell at the end of the night, they thought "that would be that", but he went home, got a bottle of whiskey, and went to the house where they were staying.
Mitchell was "turned away", but made contact by phone and went back again, determined to get in.
Judge David Tremberg told him: "By this stage the complainant was drunk and incapable.
I'm entirely satisfied you knew that was the position, because in your presence she was sick downstairs." He added: "She had to be helped off the sofa, she had to be helped upstairs.
She was sick.
She was placed in bed by the two of you.
She was sick again.
She was entirely incapable of consenting to sexual activity in any way and you knew it.
In the few minutes her friend was gone, Mitchell, of Wilbert Lane, Beverley, undressed himself and his victim and was sexually assaulting her in bed.
The judge said: "I also find it was clear if she had not interrupted you would have gone further.
[Her friend] came back and you were caught in the act." Mitchell, a storesman originally from Huddersfield, was convicted of sexual assault after a trial.
The judge told him: "Unfortunately, the emotional harm that you have caused to this complainant has been deep-seated and enduring.
You targeted this complainant on this night because she was drunk and insensible and completely unable to resist you." He was ordered to register as a sex offender for life.
