FIFE DELIVERY DRIVER SENTENCED FOR SEXUALLY OBSCENE CONDUCT
A perverted delivery driver who asked a lone female how much it would cost to have sex with her committed the offence due to stress, a court was told.Gary McCool, aged 40, cornered the woman as she walked alone in Kinghorn and falsely claimed he had a brain tumour, attempting to garner her sympathy.The following day, McCool approached two different women in separate incidents in Lochgelly and made sexually obscene gestures at them, both of whom were with their children at the time.The case was heard at Dunfermline Sheriff Court, where it was revealed McCool was having unspecified issues with his neighbors at the time.
His solicitor, Zander Flett, stated: “He attributes it (the offence) to stress to do with neighbors but he has accepted that the is not an acceptable way for stress to be managed.”Since the incidents, he has not committed any further offences.Register and RestrictionsSheriff Susan Duff expressed concern over McCool’s behavior and placed him on a two-year supervision order with conditions including having no unsupervised contact with minors under 18, approval of his home and employment by social workers, and carrying out 150 hours of unpaid work.
McCool was also ordered to be registered as a sex offender.Initial Offence DetailsProsecutor Azrah Yousaf said McCool approached his first victim during the day in Kinghorn.
He drove a van slowly alongside her, with the passenger window down, and commented on her appearance, saying: “You have a nice bum.” He then claimed he had a brain tumour and was going to die, attempting to elicit sympathy.
He offered her money for her phone number and showed her a homeopathic treatment he claimed to be using for his illness, asking: “How much would it be to have sex with you?” He also remarked he could not get an erection and asked her to flash.On the following day, McCool made lewd gestures at a woman in a play park and made suggestive approaches to another woman walking with her dog and daughter.
He admitted communicating indecently with the first woman in Kinghorn on September 24 of the previous year and was also found conducting himself in a disorderly manner by making sexual gestures at two women in Lochgelly on September 25, 2020.
