DARREN MCGONIGLE BARRHEAD MAN FINED FOR COURT ORDER BREACH AND DISTURBANCE

In a recent incident that took place in Barrhead, Darren McGonigle, a 37-year-old man, faced legal consequences after violating a court order by unlawfully entering his former partner's residence and refusing to leave when asked. The events unfolded on Craighead Street in April 2023, where McGonigle's actions caused considerable concern and disturbance in the local community.

According to reports from the Paisley Sheriff Court, the trouble began around 7 pm when the victim, accompanied by her daughter and dog, returned home. Upon her arrival, McGonigle, who was visibly intoxicated, knocked on her door demanding the return of a PlayStation console that she had previously taken back. Despite her compliance, he persisted and then moved to the street outside her home, where he continued to cause a scene.

Witnesses and the victim herself reported that McGonigle's behavior was unpredictable and aggressive. She heard a male voice downstairs, which she recognized as belonging to McGonigle, and saw him under the influence of alcohol. Fearing for her safety, she cautiously descended the stairs and told him to leave her property. However, McGonigle refused to comply with her request and instead began shouting and swearing loudly from outside her flat, causing a disturbance that alarmed nearby residents.

Concerned neighbors and the victim herself called the police. When officers arrived, McGonigle had already left the scene but was later found at the front door of his flat. It was confirmed that he was subject to bail conditions that explicitly prohibited him from entering Craighead Street or making contact with the victim. His breach of these conditions led to his arrest. He was taken into custody at Cathcart police station, where he chose not to respond to the caution and charge administered to him.

During the court proceedings, McGonigle’s legal representative explained that he had consumed alcohol earlier that day and expressed remorse for his actions. The lawyer highlighted that McGonigle was now accepting the end of his relationship, was actively seeking employment, and had been making efforts to improve his behavior. The court was informed of his cooperation with community orders and his positive steps towards rehabilitation.

In sentencing, Sheriff Clare Arias imposed a fine of £320 on McGonigle, which he was ordered to pay at a rate of £20 per month. The sheriff acknowledged his cooperation and the progress he was making, emphasizing the importance of respecting court orders and maintaining public safety.
