In a disturbing incident that has shocked the community of Leamington, Daniel William Bourke was involved in a brutal act of domestic violence that left his girlfriend severely injured. The assault took place in August of the previous year, during a night when both individuals were under the influence of alcohol. Bourke, who was intoxicated at the time, launched a violent attack on his partner, 34-year-old Andene Harvey, inflicting more than 20 stab wounds on her body.The injuries sustained by Ms. Harvey were extensive and life-threatening. She suffered stab wounds to critical areas including her neck, back, and stomach, which resulted in internal injuries that required urgent medical attention. The severity of her condition was such that she was placed into an induced coma, a state she remained in for three weeks as doctors worked tirelessly to stabilize her and treat her injuries.
It was revealed during court proceedings that Daniel Bourke and Andene Harvey had been involved in a tumultuous relationship spanning seven years. Described as volatile, their relationship was marked by episodes of violence from both sides, often exacerbated by alcohol consumption. The incident in question was a culmination of this troubled history, with Bourke later admitting to the act of wounding with intent during a hearing at Warwick Crown Court in April.
Following his admission, Bourke was sentenced to a prison term of 10 years. Additionally, due to his classification as a 'dangerous' offender, he was ordered to serve an extra five years on licence after his release, ensuring extended supervision and monitoring. However, the case took a turn when the appeal court, presided over by Mr. Justice Green, reviewed the sentence. The court decided to reduce Bourke’s prison term to nine years and the extension on his licence to three years.
During the appeal, the judge acknowledged the complex history of violence between Bourke and Ms. Harvey. Both parties had been victims and perpetrators of violence, often fueled by alcohol. The court recognized mitigating factors, including provocation, and noted that Ms. Harvey had exhibited violent behavior towards Bourke in the past. Despite the initial classification of Bourke as a dangerous offender, the judge concluded that there were valid reasons to consider some leniency, though he emphasized that Bourke still posed a significant risk to future partners. As a result, the court mandated that Bourke be subject to extended supervision after his release to prevent further incidents of violence.
