65-YEAR-OLD IN DRESSING GOWN EXPOSED PENIS TO GLASGOW TEEN
A 65-year-old Glasgow man exposed his penis to a teenager by opening his dressing gown.Daniel Gallacher went to his rear garden in Glasgow's East End around 7pm on July 3 this year, wearing his bathrobe.
He then opened it, while in view of a 16-year-old girl, who believed he was looking at her.
Gallacher was naked under the clothing and he exposed his genitals and began touching his penis.
The distressed teenager alerted a relative, who told her to record him.
During a 25-minute time period, she obtained 13 videos of Gallacher, exposing himself and touching his penis.
A while later, the same relative arrived at the property, confronted the man and called the police.
When officers arrived, they went to Gallacher's home and his partner let them in.
Cops saw him wearing the same dressing gown as in the footage.
He was arrested.
Gallacher appeared at Glasgow Sheriff Court this week, after he pleaded guilty to committing an offence of public indecency.
The crown submitted that there was a significant sexual element to the crime and emphasised that the person involved is under 18.
Gallacher's lawyer said: "He consumed alcohol to excess.
He was at his home address.
He is 65 years old and has no other outstanding matters.
He significantly reduced his alcohol intake but on this day, they were celebrating a birthday.
He did not intend to cause any harm to the individual.
He went out to the garden to urinate and in the process, his genitals were exposed.
He has remained sober since this offence." Sheriff Kevin McCarron observed: "That does not sit terribly comfortably with me because he was in that position for a 25-minute period." The solicitor explained that there was no dispute over the videos.
She added: "He accepts the harm that the complainer would have, after witnessing this incident.
His level of intoxication affected his memory.
He is not a man who is often before the court.
There is no sign in the report that there is any sexual deviance." Sheriff McCarron stated: "It’s clear that the offence is somewhat more serious than the picture you paint.
I am satisfied that it can be dealt with in a way other than custody.
I am satisfied that there is a sexual element and it’s significant." Gallacher was sentenced to two years of supervision and will be subject to notification requirements under the Sexual Offences Act of 2003.
